This one seems to be written in lawyer speak, and I can't claim to understand it fully. However, I don't quite see how it forbids a state from bringing suit on a foreign state?
Yeah, It's similar to the difference between "you can't not do this" and "you must do this". There seems to be a bit of wiggle room in the first version that's not there in the second.
